Why you should NEVER talk to a cop without a lawyer present

A law professor AND a policeman explain why you should never never never talk to a policeman about ANYTHING unless you have a lawyer present.
It's almost an hour long. The visual portion itself is nothing but the audio information in it is extremely valuable. If you don't want to sit and listen to it, turn up your computer and do something around the house while you're listening to it.
It may save you a few years.

Two homes destroyed by twisters in a year and he calls it quits?

HARVEST, Ala. (AP) — Cody Stewart is done owning a home for a little while. He has lost his house to tornadoes twice in 10 months.
A killer twister wiped out his neighborhood in the epic Alabama storms April 27, causing Stewart $40,000 worth of damage that forced him to temporarily move in with his parents. In his house for less than two months with repairs still incomplete, another tornado hit again Friday, ripping off the roof, slinging it into the backyard and leaving the walls bowed outward.
This time, the damage is beyond repair.
"I kind of expected there to be more storms again this year, but you never expect it to hit the same place twice," Stewart said Saturday as he stood in what remains of his wood-frame home. "I think I'm going to live in an apartment awhile. I'm not superstitious, but it just kind of seems there's a path here and I don't want to be in it again, and I hope other people make the same choice."

5 Reasons You Should Never Agree to a Police Search

Read this article here

Do you know what your rights are when a police officer asks to search you? If you're like most people I've met in my eight years working to educate the public on this topic, then you probably don't.
It's a subject that a lot of people think they understand, but too often our perception of police power is distorted by fictional TV dramas, sensational media stories, silly urban myths, and the unfortunate fact that police themselves are legally allowed to lie to us.

It wouldn't even be such a big deal, I suppose, if our laws all made sense and our public servants always treated us as citizens first and suspects second. But thanks to the War on Drugs, nothing is ever that easy. When something as stupid as stopping people from possessing marijuana came to be considered a critical law enforcement function, innocence ceased to protect people against police harassment. From the streets of the Bronx to the suburbs of the Nation's Capital, you never have to look hard to find victims of the bias, incompetence, and corruption that the drug war delivers on a daily basis.

Whether or not you ever break the law, you should be prepared to protect yourself and your property just in case police become suspicious of you. Let's take a look at one of the most commonly misunderstood legal situations a citizen can encounter: a police officer asking to search your belongings. Most people automatically give consent when police ask to perform a search. However, I recommend saying "no" to police searches, and here are some reasons why:

1. It's your constitutional right.
The 4th Amendment to the U.S. Constitution protects us against unreasonable searches and seizures. Unless police have strong evidence (probable cause) to believe you're involved in criminal activity, they need your permission to perform a search of you or your property.
You have the right to refuse random police searches anywhere and anytime, so long as you aren't crossing a border checkpoint or entering a secure facility like an airport. Don't be shy about standing up for your own privacy rights, especially when police are looking for evidence that could put you behind bars.

2. Refusing a search protects you if you end up in court.
It's always possible that police might search you anyway when you refuse to give consent, but that's no reason to say "yes" to the search. Basically, if there's any chance of evidence being found, agreeing to a search is like committing legal suicide, because it kills your case before you even get to court.
If you refuse a search, however, the officer will have to prove in court that there was probable cause to do a warrantless search. This will give your lawyer a good chance to win your case, but this only works if you said "no" to the search.

3. Saying "no" can prevent a search altogether.
Data on police searches are interesting, but they don't show how many searches didn't happen because a citizen said no. A non-search is a non-event that goes unrecorded, giving rise to a widespread misconception that police will always search with or without permission.
I know refusing searches works because I've been collecting stories from real police encounters. The reality is that police routinely ask for permission to search when they have absolutely no evidence of an actual crime. If you remain calm and say no, there's a good chance they'll back down, because it's a waste of time to do searches that won't hold up in court anyway.

4. Searches can waste your time and damage your property.
Do you have time to sit around while police rifle through your belongings? Police often spend 30 minutes or more on vehicle searches and even longer searching homes. You certainly can't count on officers to be careful with valuables or to put everything back where they found it. If you waive your 4th Amendment rights by agreeing to be searched, you will have few legal options if any property is damaged or missing after the search.

5. You never know what they'll find.
Are you 100 percent certain there's nothing illegal in your home or vehicle? You can never be too sure. A joint roach could stick to your shoe on the street and wind up on the floorboard. A careless acquaintance could have dropped a baggie behind the seat. Try telling a cop it isn't yours, and they'll just laugh and tell you to put your hands behind your back. If you agreed to the search, you can't challenge the evidence. But if you're innocent and you refused the search, your lawyer has a winnable case.

Remember that knowing your rights will help you protect yourself, but no amount of preparation can guarantee a good outcome in a bad situation. Your attitude and your choices before, during, and after the encounter will usually matter more than your knowledge of the law. Stay calm no matter what happens, and remember that you can always report misconduct after things settle down.

Finally, please don't be shy about sharing this information with your friends and family. Understanding and asserting your rights isn't about getting away with anything, and it isn't about disrespecting police either. These rights are the foundation of freedom in America, and they get weaker whenever we fail to exercise them.

Why you should piss in the BACKyard

A Frenchman claiming that a Google Maps' Street View picture of him peeing in his front yard has made him a "laughingstock" is suing the tech giant for 10,000 euros.
"Everyone has the right to a degree of secrecy," his lawyer, Jean-Noel Bouillard, told Reuters. "In this particular case, it's more amusing than serious. But if he'd been caught kissing a woman other than his wife, he would have had the same issue."
The man, who was not identified but referred to as in his 50s and living in a village of 3,000 in the Maine-et-Loire region, "He discovered the existence of this photo after noticing that he had become an object of ridicule," Bouillaud told AFP, asking that the name of the village not be published.

The Street View photo has the man's face blurred out, but villagers figured out who the man was immediately, according to Bouillaud. Bouillaud did not explain why his client was peeing in his front yard instead of his home, only that the man was on his own property with the gate closed. The man is suing Google for 10,000 euros (around $13,000) in damages.
Google's Street View has a collection of unusual photos and peeing isn't the half of it -- apparently it captures lots of prostitutes, drunkenness and public nudity, as well as a some very beautiful landscapes.
We're not sure if the man has a case, because we're not familiar with French law, but in America what can be seen from the street is fair game. Think of that the next time you're too lazy to go inside the house to use the bathroom.

Shooting the .950 JDJ



JD Jones is known for his wildcats and barrels for the TC Contender for them.
Hell of a nice guy, I talked with him on the phone several times back the mid- 80s when I was after him to build a specialty barrel for my TC in 41 magnum. I already had a barrel that fired a standard length bullet just fine, but I was loading some 280 gr WFN bullets that stuck out considerably further than the 210 grain bullet. Fucking bullet would hang up in the rifling, keeping me from closing and locking up the handgun. JD saved me a few bucks by refusing to build me a custom barrel and just took a standard 41 tube and drilled out the chamber a few thousands of an inch, polished it, and sent it off to me. I think he charged me $100 for the ream and polish job, plus the price of the barrel ( so $225 total?) and I was shooting  within 3 months of ordering it.

Just when you thought the government couldn’t ruin the First Amendment any further: The House of Representatives approved a bill on Monday that outlaws protests in instances where some government officials are nearby, whether or not you even know it.

The US House of Representatives voted 388-to-3 in favor of H.R. 347 late Monday, a bill which is being dubbed the Federal Restricted Buildings and Grounds Improvement Act of 2011. In the bill, Congress officially makes it illegal to trespass on the grounds of the White House, which, on the surface, seems not just harmless and necessary, but somewhat shocking that such a rule isn’t already on the books. The wording in the bill, however, extends to allow the government to go after much more than tourists that transverse the wrought iron White House fence.

Under the act, the government is also given the power to bring charges against Americans engaged in political protest anywhere in the country.

Under current law, White House trespassers are prosecuted under a local ordinance, a Washington, DC legislation that can bring misdemeanor charges for anyone trying to get close to the president without authorization. Under H.R. 347, a federal law will formally be applied to such instances, but will also allow the government to bring charges to protesters, demonstrators and activists at political events and other outings across America.

TOKYO (Newscore) - Japanese researchers have invented a speech-jamming gadget that painlessly forces people into silence.
Kazutaka Kurihara of the National Institute of Advanced Industrial Science and Technology, and Koji Tsukada of Ochanomizu University, developed a portable "SpeechJammer" gun that can silence people more than 30 meters away.
The device works by recording its target's speech then firing their words back at them with a 0.2-second delay, which affects the brain's cognitive processes and causes speakers to stutter before silencing them completely.
Describing the device in their research paper, Kurihara and Tsukada wrote, "In general, human speech is jammed by giving back to the speakers their own utterances at a delay of a few hundred milliseconds. This effect can disturb people without any physical discomfort, and disappears immediately by stopping speaking."
They found that the device works better on people who were reading aloud than engaged in "spontaneous speech" and it cannot stop people making meaningless sounds, such as "ahhh," that are uttered over a long time period.
Kurihara and Tsukada suggested the speech-jamming gun could be used to hush noisy speakers in public libraries or to silence people in group discussions who interrupt other people's speeches.
"There are still many cases in which the negative aspects of speech become a barrier to the peaceful resolution of conflicts," the authors said.

I've been checked on, Lisa

My phone rings. The screen shows it my loving mother and seeing as she's doing my taxes this year, I better take that call. Besides, Lisa's been asking if she'd called yet.
"Hey."
"Hello My Eldest And Most Beloved Son. This is your mother. I was instructed by Miss Lisa to call and check on you. Please answer the following questions: Are you injured?"
Ah, that's why Lisa's been asking if she called.
"Nope" after a quick check just to be sure.
"Are you gunshot?"
"No, not so far today." And hopefully not for the rest of the day.
"Are you eating?"
"Twice a day."
"Where's your dog?"
"At my feet, asleep."
"Consider yourself checked. You're fine. Good night, Son. I love you." Click.
Love you too, Mom.

I did call her back a minute later just to visit but she was getting ready to go save the somebody from something and said she'd call tomorrow.
Okay, you've heard quite a bit about Pops, Mom, not so much. Let me explain Mom to you.
72 years old and has more energy than a 5 year old. She's one of those people that can jump right into the middle of in any crisis and not only take control but solve the problem. She thrives on that shit.
Somebody dying and the family needs help with the arrangements? No sweat, Mom's buried a shitload of people. Going through a divorce/family law matter? Call Mom, she knows the perfect lawyer. Got a cut-off notice and can't take the day off to pay it? Mom will drop it for you. Need help painting? She's there with tarps, brushes and her Senior Citizens discount for paint. Somebody killed in a car accident? Call Mom - she'll call the family, handle the cops, make the coffee and even go down to identify the corpse for you, picking up a bucket of fried chicken and slaw on the way home.
Fuck, when I was going through my divorce she made about half the appearances for me and even went to a couple of my attorney appointments for me. It got to the point to where she was referring to my attorney as "our" attorney. Whoa, Mom. You start paying for my attorney, you can call her 'ours'. Until then, she's mine. Yeah, I think Mom was actually disappointed when me and The Evil One finally settled and she couldn't go to court no more.
But then my Grandpa Bud caught that cancer that's been going around (as he put it) and gave Mom something else to do for a year or so as her and Aunt Sharon ran 12 hour shifts taking care of Bud until he finally up and died on us after years of threatening to do so.
Then n-o-t-h-i-n-g bad happened for a few months and Mom damned near drove Pops mad trying to create a crisis. Thankfully Pops was rescued when my Uncle had a heart attack and lingered in a coma for a couple of weeks before succumbing to a lifestyle of burgers, fries and milkshakes. I was considering getting jailed just to get Mom off Pops' ass when Gary fucking locked up while eating a six pack of tacos. The timing couldn't have been better as far as Pops was concerned.
That kept Mom going for about a month - sitting at the hospital for almost 2 solid weeks, then making arrangements, then the funeral itself (thank God it was a cremation, Gary was huge. You couldn't pay me to be a pall bearer) and then helping the rest of the family to make their mourning easier, like babysitting and cooking, shit like that. In the background but making a huge difference.


Mom and Pops and me on their 50th Anniversary 


She's raised 3 hell raisers, mostly alone while Pops was hunting and fishing all around the world on Uncle Sam's dime while running the occasional combat patrol. After my sister died back in 97, she took on her 3 kids and raised them too, finally getting rid of the last of them when the youngest reports to Basic Training in April.
Not to mention putting up with Pops' bullshit for the past 53 years......

My first generation Colt Officers Model

Commenting on a blog post over at Kerodin's about a holster for my 45 got me thinking about the damned thing, so I went and found this post from a few years ago.

I was kicking back here on my bed a couple of minutes ago and saw my old Colt Officer’s Model 45 ACP laying on the cabinet next to me and had to smile when I saw where the finish has been worn off.
I actually went shopping for a Government Model when I bought my Officer's Model. I took my Dad with me and headed for the gun shops in the area. Believe it or not, I couldn't find a 1911A1 to save my life. All day long Pop had been trying to talk me out of a 1911 knowing that I was damned well going to carry that sucker around so I might as well get something a little more concealable, like a Commander. We ended up at P. V. Ranch Supply, where I saw a Colt Officer's Model for the first time. I was in love!! With the gun price, tax, transfer fees, etc., I was into the gun about $600.00, give or take 10 bucks. That little gun was beautiful. It was hefty for its' size but I figured that the extra weight would help keep the recoil on it under control. And talk about easy to hide, with a 3 1/2" barrel and a 6 shot magazine you could hide it under a t-shirt with the right holster.
Most people don't put 500 rounds through their handguns during the entire life of the gun, but I ran 500 rounds through mine the very first day I owned it. I left P.V. and went to Gun Countrys' indoor range and bought a cleaning kit, 10 boxes of hardball, and 4 hours of range time. I shot a half a box, cleaned the barrel, fired a box, recleaned the barrel, fired a box and a half, cleaned the entire gun, fired 3 boxes, cleaned the gun, then fired off the other four boxes, stopping long enough to let the gun cool down every once in a while. I had quite a few jams at first, but that was to be expected. I mean that was the reason I burned up $150 bucks worth of ammo, to get the break in period over with. After about 300 rounds, the gun settled down and quit hanging up.
Oh, and it shoots so sweet! For that short a barrel I can hammer 6 rounds of 45 into an area the size of my fist at 15 yards as fast as I can pull the trigger. Well, I USED to be able to. For a long long time when I lived out in the country there wasn’t a day go by that I didn’t burn at least a box a day. Hell, I shot that thing so much that I had a callus on the web between the thumb and forefinger of my right hand and one on the side of my right thumb from the slide release.
I still have that gun. I've put Pachmayer wraparound grips on it, a new front sight, an extended slide release, a new mainspring, an aftermarket sear and disconnector from Kings Gun Works and have gone through a couple of barrel bushings, firing pins and firing pin springs but other than that the gun is still hanging in there. I don't think that's too shabby. I figure I have put somewhere in the neighborhood of 10,000 rounds through that Colt, and I can back that up with receipts for reloading supplies and loaded ammo.
I don't carry that gun as much as I used to or should. As a matter of fact, it's pretty much a house gun now. But I tell you what I'll never get rid of it. It's just too much like a part of me, like a member of my own family.

May I have your attention please?

No, this ain't my finger

While sober and after careful and lengthy deliberations on my part, I've come to realize that I love Miss Lisa very much and that I have not given any consideration to life without her.
We've been together 10 months, lived together for almost 8, and have yet to have a cross word or disagreement. My life with her is stress-free. She accepts my stance on my political views and occasionally even agrees with them.
Seriously. I could do a lot worse.
So Friday night I got down on my knees - both of them, I'm 52, godammit - and proposed and she accepted without laughing at me, hesitation, or reminding me of a restraining order.
We hugged, kissed and then CharlieGodammit immediately ran over and jacked me out of the way so he could get some of whatever was going on. Whatever.

There are a couple of added bonuses too. There's the 80 bucks a week extra when I change my withholding and last but not least, she can't be compelled to testify against me in a court of law. That can be important, ya know.

So then Monday I drove her to the airport so she could head back to Tennessee for a couple of weeks to visit with her family and take her grandbabies to Walmart.
The week prior, she kept busy by preparing meals for me and freezing them, telling me where the cleaning utensils were, how to make coffee, doing all the laundry down to the last sock and still trying to tell me how to use the washer and dryer, telling me when to water the plants, you name it.
I finally had to stop her and let her know I done this shit before, man.

The first day out, I dump a load of Copenhagen in the toilet and then amuse myself by pissing the wad apart so it's loose and floating everywhere. Then I flush and instead of it all going to San Francisco like it's supposed to, it all just sat there, swirling around. I looked everywhere but I can't find a plunger. Okay, I looked in only 2 places - under the sinks and next to the toilets, where the hell else do you keep a plunger - but it ain't there.
Fuck.
Well, we haven't needed one since we've been here so maybe it's out in the garage with all of our my shit that still hasn't been unpacked, so I throw on a Tshirt and go out to the garage and peer into maybe 3 boxes. No luck.
Fuck again.
Okay, this is a no-brainer. I don't know why I'm even tripping on it. She's going to be gone for 2 weeks and I got 2 bathrooms and I ain't expecting no company.
Problem solved. For 13 days anyways.

She calls this afternoon for a chat and things work around to dinner. I know she's concerned that I'm going to starve and she knows I know, so she's trying to be tactful about it. But I already know, so what's the point? I'm going to fuck with her about it.
Anyways, she asks what I'm doing for dinner.
"Meat" I replied.
"Meat?"
"Meat. I'm smoking some meat for dinner. No vegetables, no fruit, no motherfucking salad, just meat. Heh heh heh." I was starting to get defiant here.
"Well, what kinda meat are you smoking, Bubba?" She didn't care how pissy I was getting.
"Pig meat. What the hell did you expect?" I mean, seriously? C'mon Woman, give me your best shot.
"Well, you just enjoy your pig meat, darlin', and remember that I love you."
Damn. 2 whole weeks til she comes back home......

Well, good for you because I won't leave it up to the government to decide what's right for me, my family and my Country.
You see, my world doesn't revolve around me like yours does. My world revolves around my wife-to-be, my family, even my dog, and making sure their daily needs are met - which is becoming increasingly harder thanks to this governments' runaway spending and subsequent thoroughly fucked-up economy.
But your personal well-being doesn't depend on the economy or intrusions on our Constitution and Bill of Rights - you're an entertainer. It doesn't even matter to you who is president or which party is in control of the House and Senate. You're an entertainer and people need to be entertained.
You have people surrounding you so you don't have to deal with low level shit like making and keeping your own appointments, fueling your own vehicles, grocery shopping on a tight budget. You're insulated from the world that is my home.
I am not holding your wealth and fame against you at all. You're obviously a very skilled driver, you've hired all the right people and you've earned every bit of what you have. Good for you, I wish you well with that.
But please keep your fucking mouth shut if you have no concept of what you're talking about.

Obama using Espionage Act to 'silence and prosecute federal workers'...

Last Wednesday in the White House briefing room, the administration’s press secretary, Jay Carney, opened on a somber note, citing the deaths of Marie Colvin and Anthony Shadid, two reporters who had died “in order to bring truth” while reporting in Syria.       

Jake Tapper, the White House correspondent for ABC News, pointed out that the administration had lauded brave reporting in distant lands more than once and then asked, “How does that square with the fact that this administration has been so aggressively trying to stop aggressive journalism in the United States by using the Espionage Act to take whistle-blowers to court?”
He then suggested that the administration seemed to believe that “the truth should come out abroad; it shouldn’t come out here.”

Fair point. The Obama administration, which promised during its transition to power that it would enhance “whistle-blower laws to protect federal workers,” has been more prone than any administration in history in trying to silence and prosecute federal workers.

The Espionage Act, enacted back in 1917 to punish those who gave aid to our enemies, was used three times in all the prior administrations to bring cases against government officials accused of providing classified information to the media. It has been used six times since the current president took office.
