California Governor Gavin Newsom is proposing a 28th Amendment to the U.S. Constitution to restrict gun ownership, following a record year of mass shootings.
The Democrat's plan would leave the 2nd Amendment unchanged and 'respect' America's 'gun-owning tradition'.
"It would include 'universal background checks, raising the firearm purchase age to 21, instituting a firearm purchase waiting period, and barring the civilian purchase of assault weapons.'"

If he thinks that he needs to codify the assault weapon restriction with a Constitutional Amendment, does that mean the other restrictions in place now are null and void (like the machine gun ban)?
ReplyDeleteThat's the honest way to attempt to change the Constitution - try to get a near-consensus to _change_ it, rather than trying to get judges to misconstrue some words and ignore others. I'd like to see Newsome find someone in the House and Senate to _try_ it and push it to a vote. There's no way they can get a 2/3 majority in even one house, but this will make each Congress member's position on gun rights clear and a major election issue, and I think it will result in a many fewer gun bigots in Congress.

ReplyDeleteThere are at least three falsehoods in that article. The Congress can’t pass an amendment by itself. They still need two thirds of state legislatures to approve of the amendment. Second, the “mass shootings” the one at the graduation was a gang or personal attack. Third, most mass shooting involve pistols not semiautomatic rifles. So, this is “fake news” at its finest.

ReplyDeleteTechnically, he's correct. The 18th amendment is still there in the constitution. Not so much as a period has changed since it was ratified in 1919. His argument falls apart if someone were to compare his proposal to the 21st amendment and what it did to the 18th.
