Agreed. It's the boat captain's fault, not the surfer. Still, that surfer should have seen the boat, assumed the captain was ignorant, and turned to avoid collision.
Maybe so, but the windsurfer NEVER LOOKED for any other traffic on the water and he was MUCH more maneuverable than the sailboat. He is a least as much at fault for the collision.
There's a clear "window" panel in the sail. So the surfer could see the boat...if he had been looking. And vice versa. Like most accidents, both parties screwed up. But navigation regs put the boat captain 100% at fault since he was crossing from the surfer's port side. The boat ran the red light.
Probably new "captain with his "captain hat" in his new boat, running autopilot while trying to impress his friends, instead of doing his job. Slight starboard turn would have just cleared him but also cut the wind from his sailboard. That would have woke up the sailboarder.
Nope… close haul has the right of way. The only option for the sailboard would have been to fall off the wind which would have taken him closer to the boat. Boat had the responsibility to give way. But as we used to hail: “bigger boat!” (didn’t mean we were right, though). SmileyFtW

#1: my father used to drive a deuce and a half that belonged to the school system. he figured anything smaller would get out of the way, anything more expensive would get out of the way and anything privately owned would get out of the way. therefore, he owned the road. impeccable logic, IMHO.
