Federal judge denies restraining order from Nashville bar owners

NASHVILLE, Tenn. (WKRN) – Attorney Bryan Lewis told News 2 the restraining order from Nashville bar owners against Metro has been denied.

Lewis, co-counsel for plaintiffs, said a Federal judge denied the retraining order filed by bar owners. The ruling stated the local health director has the authority to take such action during a pandemic.

  1. I want to know the Judge's name. The Constitution and the principle if Equal Protection gets trampled once again. Hell, with these kinds of decisions by Federal Judges then Governors and Mayors might as well publicly declare themselves complete arbiters of Law. Because apparently anything and everything is permissible under Emergency Powers. No more need for State legislators or ballot measures. Whatever State "Leaders" and unelected "Health Officials" want to do is good to go.

    As these types of rulings are happening around the country, I am wondering - on what Constitutional principle or basis does a "health director" have this authority?
    When I read the Constitution, I can't find that authority.

    1. I would say none. From the Tennessean back in Feb: "Dr. Michael Caldwell, who has worked in the public health field for at least two decades, was selected by the Nashville Board of Health to be the next director of the Metro Public Health Department." So an unelected bureaucrat. Appointed by a board of unelected bureaucrats who themselves are appointed by, guess who, the Mayor of Nashville. I'm shocked, shocked I say.

      I'd wager that this guy and every other Health Director, Board & Council member, Mayor, and Governor won't be willing to accept, let alone acknowledge, their responsibility for the lives ruined and lost from the 2nd and 3rd order effects of these rushed and badly implemented rules and orders. They'll just pass the buck to someone else.

  4. Hell no! Rulings like this are begging for appeal. DrRiff is right, if it's not in the Constitution it doesn't exist.
