Supreme Court to Hear Arguments on Trump’s Push to Exclude Illegal Aliens from Census Data

The Supreme Court on Monday will hear oral arguments regarding President Donald Trump’s push to exclude illegal aliens from U.S. Census Bureau data. 

A Trump victory in the case could alter a state’s population and potentially change its balance of power in the House of Representatives, senior counsel for the Brennan Center, a left-wing group, Thomas Wolf told CNN.

  1. I am kinda torn on this one. A clear reading of the Constitution says

    "Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed. But when the right to vote at any election for the choice of electors for President and Vice-President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such State.
    14th amendment Section 2

    Counting the whole number of persons, excluding indians not taxed, well that seems pretty clear to me. We have to amend the constitution or count every warm body that is taxed. Now, if illegals are not being taxed, there is room for argument.

    1. Have you ever had a discussion with a wetback about taxes? You really need to. One of the reasons they are here is because they can dodge taxes so easy. In Mexico and other Squatamalan countries the local cops ask around and find out how much everyone is making. Then they come to those people who are doing well and tell them to cough up so much money. It isn't a true tax, but if they don't pay it they wind up dead or in prison.
      I know wetbacks, they have worked for me. They always want to work for cash. And if they work for cash, they aren't paying taxes, so they need no representation. They "aren't really here".

      They are taxed. Being paid their wages in cash does not exempt them from being taxed. In that case they are supposed to report it anyway. Fat chance of that happening. But that isn't the point. All income is taxed. Just because someone commits tax evasion doesn't mean they are not taxed.
      Doesn't matter anyway. If they buy gas for their vehicle; they pay a gas tax. If they buy anything (except in Oregon), they pay a sales tax. If they buy property (foreign ownership of real estate is allowed), they pay property tax. Just because they are here illegally doesn't mean they are not taxed. The 14th Amendment doesn't specify what type of tax. Historically, they have been counted.

  3. So Charlie, what part of American Citizen, male, 21 yrs old did you not see in that passage?
    Just in case you need help with that... the reps will be apportioned based on 21 yr old+ male citizens in the population. Females, illegals of either sex, and everyone else DO NOT COUNT.

    If, And, Or, But (except).
    A careful reading, looking for those 4 words, in any law, gives limitless exemptions if applied correctly.

  5. Hmmmm, upon deeper reading, this clause restricts the voting pool extremely small in many if not all States:

    This means, if ANY male citizen, 21 yrs old and up, in a State, is denied the Right to vote due to criminal conviction, then the apportioned representatives must be alloted based on solely the number of 21 yr old plus males in that state.
    No mention of race, other than non taxed Indians. Excludes ALL females period. Only males 21 yrs old not convicted of disqualifying convictions. Undocumented Immigrants, or properly, Illegal Criminal Aliens, are EXCLUDED.
    THAT is the reading of the Constitution.
    Let's go with that.

    How would illegals pay taxes? With the exception of sales taxes, they would have to volunteer to pay. I just don't see that happening.

    Although, simple solution, kick them out.

  9. I don't see why this is even controversial. Illegal aliens are by definition not citizens. Therefore they shouldn't count when apportioning representatives.
