SAN LEANDRO, Calif. (AP) — A woman in the San Francisco Bay Area has been arrested on suspicion of posting handwritten messages at several homes, targeting Asian Americans and suggesting that those not native to the United States should leave the country immediately.
Police in San Leandro, a suburb of 89,000 just south of Oakland, said officers were called to the Heron Bay neighborhood Friday evening after receiving reports of notes containing “insensitive messages towards minorities” taped to five homes.

I've been trying to get more info on this from San Leandro. No report -- including the official police press release -- actually says what exactly she's charged with. Everything implies she charged with posting the notes. The only CA Penal Code that theoretically could apply just to that is § 415.
ReplyDeleteThe problem with that is Cohen v. California, 1971; in which the US SCOTUS ruled that they CANNOT ban offensive speech.
So far, the city is refusing to tell me what the charge is. I think the morons DID use § 415.
You know better than that, Bear. The "problem" you mention isn't really a problem for them, because the process IS the punishment. They don't much care whether or not it sticks. And even if she later sues and wins, the cops don't pay for their perfidy, the local citizens do.

What she does NOT have is the right to go onto someone's private property (without their express permission) and do it. And setting a deadline to leave sounds like a threat. Trespass and threatening is enough to charge her on. "Hate crime" is bullshit.

Strike down all "hate speech" and "hate crime" laws. They have no valid purpose. Their real purpose is to effectively give special protection and victimhood status to a very small minority. That "hate crime" charges are used in incidents involving blacks is *camouflage*.
If someone stabs me while yelling "fuck you, Chink!" I don't care about the "Chink" part. I care about the stabbing part. That's enough to prosecute the guy on; there is no need for the "hate speech" charge. I don't give a shit if he decided to stab me for being Chinese, for driving a Subaru, or because I think gose beer is disgusting (gose IS disgusting -- this is not up for debate). The point is that he stabbed me with deliberate malice. Period.
If someone denies that the Japanese ran a large prison camp in northern China where they did horrible "experiments" on civilians I don't need that person charged with "Unit 731 Denial". [1] If someone says the "Rape of Nanking" never happened, they're an idiot, but I have no need or desire to see them punished for being a mouthy idiot.

I mostly agree with your comment and feel "hate" crime legislation should be rescinded. But the U.S. has done some horrific "experiments" involving Humans. Do a search for "MK ULTRA" and CIA. We're no better than the Chinese when it comes to horrible torture and mind control experiments. Let's not forget those "black sites" and "rendition" too!
