There's More to the Story of the 'Elderly' Protester Knocked Down by Buffalo Police Than You're Being Told

On June 4, protesters were gathered in Niagara Square, a public plaza at the center of Buffalo’s government district. When they lingered beyond 8 p.m., Deputy Chief Police Commissioner Joseph Gramaglia ordered police to enforce the curfew and clear the area. Officers from the Buffalo Police Department and the New York State Police assembled in a skirmish line and began walking north in front of City Hall.

In a now widely seen video, shot by WFBO radio reporter Mike Desmond, Gugino can be seen walking directly toward the officers and stopping in the path of one of them. Note that Gugino is carrying (alas for him, not wearing) a helmet, suggesting he was a veteran protester and prepared for a confrontation.

Of course, the MSM has a different take on it:

WASHINGTON (AP) — President Donald Trump ignited fresh controversy over his hard-line “law and order” push Tuesday by peddling yet another unfounded conspiracy theory, this time trying to raise suspicions about a 75-year-old protester who was hospitalized after being shoved by police and falling.

Trump tweeted without evidence that the confrontation in Buffalo, New York, may have been a “set up” as he once again sided with police officers over protesters and demonstrated anew his willingness to spread and amplify bogus charges cooked up by far-right outlets.

  1. I first learned about skimming through a group at a ham radio expo, a year or so ago, after watching the video a couple times the old guy's hand movements definitely look suspicious.

  2. It look to me like he had put his hands on at lease one of the police. That probably could have been considered assault. Here is some doddering old fuck that approached the police (alone) during a demonstration (riot), gets in their face and is repealed with what appears to not be excessive force. No sympathy here.

    1. Touching someone is not assault.

The old goat was a professional protestor and he was acting like a fool, but it doesn't excuse how the police handled it. Sic the rookie on the old man and manhandle him to the side of the street for detainment, but don't shove him.

Bluetooth is not going to accept random connections without user authorization unless someone is a total moron and changed their security settings to accept all connections. Most people don't even use bluetooth and it serves mostly as a redundant backup.

I could see him using it to get badge numbers and name tags though, but that isn't illegal. Maybe he had it in his hand to make it impossible for anyone to accuse him of grabbing for a gun. Can't grab if your hands are full.

He played a stupid game and won a stupid prize, everyone's conduct is inexcusable, punish them all and let God sort it out.

    2. Touching a police officer while he is attempting to enforce the law is not only assault, it is 3rd degree assault, and a felony in Kentucky...

    3. in NH, touching anyone without consent is simple assault.

  3. so I am a nobody but it certainly looks like he wanted to get close and he was manipulating his phone for some reason. One possible reason it to turn on a recorder, another could be to collect/connect bluetooth ids, another could be for frequency acquisition.

  4. If the old buzzard violated federal or state law(s) as stated in the article then he should be charged and immediately adjudicated-if for no other reason to show that the rule of law still exists and that their side can be "held accountable" too (what a fucking wimpy term-great slogan for politicians and liberals: "We're gonna hold YOU accountable (but not US)".

Gugino has lived in a couple dozen cities-including Berkeley. Something very strange about him, his two layers of masks, and the plastic tubes mostly hidden behind-not a very good actor, but the clueless half of the country loves the moron.

  5. Laying hands on a person in any way with intent to obstruct them, who does not consent, is assault in all 50 states.

  7. I'm certain that I would not storm up to a cop and do anything remotely like that. I also know if I were walking down the street and he got in my face and starting flailing his arms while yapping and shoving a cell phone at me that I would have put him on his ass with a lot more prejudice than the cop did.

  8. For the Anonymous detractor who posted about assault and bluetooth not connecting without activation:

Other folks have addressed your misguided claim of touching not being assault but I'll add this. Just raising your hand at someone, which can be construed as a threat, can be considered assault. Touching someone against their will is battery. If some stranger came up to my wife and started shoving his hand towards her phone or no phone I'd punch his lights out.

Second, do some basic research on electronics and wireless communications before you make any claims about it. Scanning devices including modified cell phones can detect, monitor, record, and even clone or jam wireless signals.

Lastly, even if people think assault and electronic warfare are acceptable in this situation this man was being an idiot in his attempts to oppose the police. He approached the line by himself, acting confrontational, and failed to use his helmet in a situation that was very likely to end in a scuffle. If you're gonna do illegal or dangerous stuff you shouldn't be stupid about it.

  9. Well, why the fuck would president Trump even consider siding with the protester who want him and his supporter dead .... why .... Side with the police in these matters, the rioters will turn on you if you fart the wrong way.
