In an important win for Fourth Amendment advocates, a Virginia man's arrest for refusing to show identification to the police has been ruled unconstitutional by a federal appellate court.

  1. completely agree w this. unfortunately most cops won't "get the memo" and in this case his driving while black circumstances made all the difference. You white guys shouldn't try this though

  2. "But the notion that the driver of a broken-down vehicle creates suspicion of criminal activity by approaching the officer trying to render him aid, put candidly, defies reason," Well we are talking low IQ police aren’t we? Got to love Wingate, “am I being detained?”, “am I free to go?” Over and over. That sure as hell gets the orks railed up! Orks hate it when free men question their authority. In a way I’m all for defund the orks.

  3. Guess the race... A black guy dressed all in black doing monkey business with a vehicle on the side of the road gets to stand on his 4th amendment rights. A White guy would have just been arrested and then laughed at for trying to claim any rights.

    1. Here I am Snuffy. And in other news today 3680 police stops resulted in no conflicts with the public at large and everyone went on their happy way. You're argument is about as stupid as banning guns because a few idiots murder people with them. Generalize Much?

    2. Again, all you need to do is visit youtube, and without even trying very hard, you can find literally thousands of videos documenting a member of the blue gang doing the exact same thing to someone who has broken absolutely no law, but only because they believe they have the authority to do as they please and your rights be damned. Whether they claim you are trespassing, or ran a red light or acting "suspicious", you are better off if you or a some neutral party are recording the encounter. Otherwise, next time it might be you that gets 3 colonoscopies in search of non existent drugs.https://www.usnews.com/news/articles/2014/01/14/new-mexico-man-given-forced-colonoscopy-by-cops-wins-16-million-settlement
