  1. They are desperate....this is one of the THOUSANDS of laws that those in power use to turn citizens into felons.

    1. Isn't turning every citizen into a felon the goal? That way if you do something they don't like, they can remove you from the public stage. As long as no one complains and you don't go against them, they'll leave you alone. Question why their hand is in the cookie jar and off to the gulag with you.

In general, courts have concluded that employees do not have a reasonable expectation of privacy while they are at work. See Jatar v. Lamaletto, 758 So.2d 1167, 1169 (Fla. 3d DCA 2000).
To support this privacy analysis, the Supreme Court has created a hierarchy of privacy interests:
First, expectations of privacy that "society is 'prepared to recognize as legitimate' have, at least in theory, the greatest protection. Second, diminished expectations of privacy are more easily invaded. Third, subjective expectations of privacy that society is not prepared to recognize as legitimate have no protection.
Jeff Davis is a public servant working at a government office and answered the phone as the government official. They had a conversation about government business. Jeff Davis has absolutely ZERO personal expectation of privacy and he has no legal standing to expect privacy on behalf of his employer. The Titusville police know this, but the arrest really wasn't for violating any wiretap laws. It is a retaliation for this man showing what tyrants these police are, how they violate people's rights, don't even know the laws they are supposed to enforce and get their egos bruised when anyone dares to stand up to them or assert their rights. EVERYONE should be calling the Titusville police chief, the city counsel, and Jeff Davis about this and demanding that they end the prosecution of this man. Anyone who supports this violation of rights, laws and abuse of power is wishing this conduct on themselves.

    1. The process IS the punishment. Which is probably the strongest argument against qualified immunity.

  4. That part of Florida law needs to be changed. When I lived in Georgia, only ONE person involved in the conversation had to be aware of the recording.
