It is not known when the state learned Freeland's identity, but it has been confirmed that he had wanted immunity before he would testify, and that Assistant District Attorney Thomas Binger would not grant it.

So the DA not only knew who he was and hid the witness from the defense, but he didn't even charge him with assault.
Prosecution is daring the judge to declare a mistrial to cover his inept handling of this dog and pony show. He should be disbarred.
