Actually a good question. Child support is not normally deductible to the parent paying it. Civil legal judgments are not typically deductible unless sufficiently business-related, but may be taxable to the recipient. And defending oneself against criminal charges may be deductible. Restitution may be deductible, but penalties and fines typically are not. So it may depend how this is categorized.
SB1834 characterizes the payment as "child maintenance". Likely to be litigated, but the going in language sounds like support payments, not restitution. And it survives reaching 18; kill a kid's parent when the kid is 5, and you're on the hook for 13 years until you pay it off. Not an award to the surviving parent/relative, but an award to the kid, directly. Or so it looks.
Now if we could just get rid of the various made-up qualified immunities and asset forfeiture, we'd be making real progress.
Actions and or choices have consequences. As I have paid for poor actions and choices all my life, so should all. So far my stupidity has not caused injury or death, but have resulted in financial costs and embarrassment. Hopefully, I no longer engage in stupidly.
Since child support is calculated on the wage earner, this makes no sense. I guess you could hope that if the unthinkable happens, it will be a rich drunk.
What about murders paying for survivors, or rapists paying for child support? That law was doomed since the idiots thought of it...
