Okay, how about robbery?

COLUMBUS, Ohio (AP) - An Ohio man acted so brazenly when he stole a $500 leaf blower from a residence that it wasn’t a burglary, the state Supreme Court ruled Wednesday.

  1. So the "incident" doesn't meet the legal threshold of burglary. How about theft or stealing? Are either one of those illegal in Ohio?

  2. I wonder what would have happened if the owner had physically intervened? I have a feeling he would have gotten his ass kicked or ended up dead. With that kind of boldness I'd say the thief had a plan B.

  3. Lax courts and prosecutors will end up fueling a return to vigilantism. This is going to end up badly.

    2. What you said is correct, Charlie, except the incident didn't happen in Columbus, it happened in Portsmouth which is down on the Ohio River over 80 miles away.

  5. I'd think it would be strong arm robbery since the victim was present and intimidated

  6. By that logic, all the shoplifting where people just load up a cart and walk out the door becomes criminal trespassing?

I actually had a dream about something like this once, of a huge guy walking around the neighborhood just taking stuff and loading up his car... Not a lot you can legally do in most places.

    2. He lives in a neighborhood, so too many eyes for SSS...

Probably doesn't have a convenient well or mine-shaft to dump the body either. Any auto is easy, walk away with it running near a place of diversity...

So glad we moved out of that state. TN ain't heaven but... ;)

  10. This shit is fucked up. Is there a law that says "secret, sly, or clandestine conduct" has to be a part of it to be criminal??? Dude would've gotten shot around here...
