Miller told the judge presiding over his case, he “had no recollection” of the events he’s facing charges for.

Oh, he doesn't REMEMBER it, so he's cool then, let him go! Actually I once heard a presentation by the then-head of the Federal Bureau of Prisons who spoke about recidivism rates and re-entry to society after prison. One of the things he said was that roughly 70% of prisoners cannot recall doing the crimes for which they were charged. Imagine being in a blackout on drugs or alcohol, and waking up in jail, or on trial, or going to prison for something you cannot remember.
ReplyDeleteHow can you defend yourself when you don't remember the crime? If that's bad, it's worse if you are actually innocent and weren't even there...
DeleteI have a suggestion: don't get blackout drunk and you won't have these problems.
Many years ago, comic Steve Martin suggested that "I forgot" is a perfectly acceptable excuse for any number of various crimes. "I forgot that B&E is against the law, your honor."
ReplyDeleteAnd he'll be under the jail- compared to what would have happened to Moe and Joe back in the 80's for basically the same thing...
