The Senate voted 27-9 on Thursday to approve Assembly Bill 28, which would require manufacturers, vendors and dealers to pay an 11% tax on guns and ammunition to fund violence prevention efforts. The bill passed with exactly the two-thirds threshold needed for approval of a tax.

ReplyDeleteThis is the equivalent of a poll tax. If it's not overturned at the state level, it'll go to the SCOTUS. A few years ago, the SCOTUS ruled that Illinois' fee for a FOID (gun ID) card was a tax on a right and therefore unconstitutional. This is effectively the same thing.

Not "completely legal" but rather "arguably legal" or "as yet has not been challenged in court". No one has sued over that specific act yet. Doesn't mean it can't be found unconstitutional, and overturned. Bad laws exist until someone objects and takes the government to court. Whether Pittman-Robertson is bad law.... that's the question. I certainly think that at best it skirts a constitutional violation by the thinnest of margins, but that's my opinion and analysis at this time.

They're the best, and I can't remember the last time they lost a gun case against California, including at the Supreme Court. But if Gavin wins in 2024 and begins packing the courts with ideological lunatics like himself all bets are off.
