California Democrats pass state tax on guns and ammunition

California lawmakers will send a state excise tax on guns and ammunition to Gov. Gavin Newsom after years of failed attempts by Democratic legislators.

The Senate voted 27-9 on Thursday to approve Assembly Bill 28, which would require manufacturers, vendors and dealers to pay an 11% tax on guns and ammunition to fund violence prevention efforts. The bill passed with exactly the two-thirds threshold needed for approval of a tax.

Yup, you read that right - California is going to tax one of our Constitutionally protected Rights..

  1. I wonder if the 13% is going to pay the 11%......

  2. They need to hurry up and pass the poll tax too! Although that is outlawed by the 24th amendment, so is their restriction (through taxing) on the 2nd.

    1. We know that their poll tax will only be applied to the conservatives and the 9th circus will uphold it through the commerce clause.

    2. This is no different than a poll tax, same concept and it should be swiftly overturned.

  3. All CA knows how to do is levy taxes. They are a black hole. And they wonder why people are leaving the state.

    1. No, they really don't. More to the point they don't believe it and even if they find it's true they still don't care. 30 years in that state and it always managed to get worse and worse every year.

  4. Manufactures, vendors, and dealers won't be paying. Customers will be paying. Where the customer is an agent of the government, the taxpayers pay that too.

Manufacturers and venders need to ixnay aliforniaCa.

For those in CA expressing their 2A right, cash donations are accepted. Include location and time for an airdrop.

    1. Gonna disagree there; it's gonna go to the Governor's cronies to run bogus "Gun Violence Intiatives" and pro-Gun Control organizations.

  10. This is the equivalent of a poll tax. If it's not overturned at the state level, it'll go to the SCOTUS. A few years ago, the SCOTUS ruled that Illinois' fee for a FOID (gun ID) card was a tax on a right and therefore unconstitutional. This is effectively the same thing.

You people need to research a little more before commenting. This type tax exists already at the Federal level and is completely legal.

    2. Not "completely legal" but rather "arguably legal" or "as yet has not been challenged in court". No one has sued over that specific act yet. Doesn't mean it can't be found unconstitutional, and overturned. Bad laws exist until someone objects and takes the government to court. Whether Pittman-Robertson is bad law.... that's the question. I certainly think that at best it skirts a constitutional violation by the thinnest of margins, but that's my opinion and analysis at this time.

  11. Sounds unconstitutional to me, The only reason that there isn’t a sales tax on newspapers is that such a tax would abridge first amendmen5 rights.

    1. The California Rifle and Pistol Association will be on this like ugly on ape. They're the best, and I can't remember the last time they lost a gun case against California, including at the Supreme Court. But if Gavin wins in 2024 and begins packing the courts with ideological lunatics like himself all bets are off.

Can you imagine Kamala Harris as a Supreme Court justice?

  12. I bet its not earmarked for violence prevention, but goes straight into the general fund.

  15. People will go out of state & purchase without paying the tax, so local businesses will lose customers & go broke.
Which is the plan, no doubt.
