Because the "parents" cannot contract away the child's rights to support. There is no family court in the world that would allow those contracts. So what you do is force them to take out an insurance policy or post a bond with the donor as beneficiary to cover child support costs. In essence, make the "parents" give you the value of any future child support payments ... indemnify the donor. That might work. But it would be prohibitively expensive ... because having to pay the child support is a sure thing.

1:42 PM is correct that parents can not contract away a childs' right to support.
ReplyDeleteSo far, medical intervention in artificial insemination breaks the chain of responsibility, possibly based on commercial law, in the "sale" of the sperm as a product.
I wouldn't put it past a Prog court to assess support against a sperm donor on grounds of "fairness" or some other fiction.
