Supreme Court Rules Gov Officials Can Block Constituents from Their Social Media Pages in Certain Situations

The Supreme Court unanimously ruled Friday that there are circumstances when government officials can permissibly block a constituent from their social media pages, provided they are not claiming to speak on the state’s behalf.

The case, Lindke v. Freed, stemmed from Port Huron, Michigan, resident Kevin Lindke’s First Amendment lawsuit against city manager James Freed (pictured above), who blocked Lindke from his Facebook page over comments criticizing the city’s response to COVID-19. While officials may look like they are “always on the clock,” not every encounter is “part of the job,” Justice Amy Coney Barrett wrote in the opinion of the court.

  1. I don't know enough about the particular case to have a specific opinion on it BUT if an elected official posts his personal social media link on a government website as a way to contact him, it is no longer a personal social media space for him. He should not be able to block anyone from it.

  2. I guess if a govt pencil pusher puts their own social media account up on a govt site, someone needs to tell them to remove it and use their govt contact info. But Barrett is a liberal, so if you can shut off opposing voice she will be for it. Even if trump put her there.

  4. Meh. Why bitch at them online when tying them to a chair, and getting out the blowtorch and pliers works so much better? Don't have to be worried about them insulting you with a form letter style response then, either.

    Hint: rule of law is over, for now. Best get to understanding and operating within that reality. Besides, insulting them by complaining will now get you the same persecution that shooting them in the face would. Kind of removes the incentive to play civil, doesn't it?
