RUTHERFORD INSTITUTE DEFENDS MARINE ARRESTED, INCARCERATED IN PSYCH WARD & DETAINED INDEFINITELY FOR POSTING POLITICAL VIEWS, SONG LYRICS TO FACEBOOK
CHESTERFIELD, VA— The Rutherford Institute has come to the defense of a former Marine, 26-year-old Brandon Raub, who was arrested, detained indefinitely in a psych ward and forced to undergo psychological evaluations based solely on the controversial nature of lines from song lyrics, political messages and virtual card games which he posted to his private Facebook page. Although the FBI and Chesterfield County police have not charged Brandon Raub, a resident of Chesterfield County, Va., with committing any crime, they arrested Raub on Thursday, August 16, 2012, and transported him to John Randolph Medical Center, where he was held against his will due to alleged concerns that his Facebook (FB) posts were controversial and "terrorist in nature." In a hearing held at the hospital, government officials disregarded Raub's explanation that the Facebook posts were being interpreted out of context, sentencing him up to 30 days' further confinement in a VA psych ward. In coming to Raub's defense, Rutherford Institute attorneys are challenging Raub's arrest and forcible detention, as well as the government's overt Facebook surveillance and violation of Raub's First Amendment rights.

As a recently retired FedGov intel officer, I can tell you that ANY and ALL social media platforms are being mined for data hits 24/7. NSA's got basement levels full of super computers that do nothing but search blogs, surf social media, parse all email (US and foreign) and even monitor phone/cell conversations....all searching for those "flags" or codeword phrases that The Masters have decided are terroristic.

Not having read Raub's FB posts, we have no way of knowing if there was a legitimate reason to Baker Act him. I would like to believe that the Rutherford Institute did review his posts before deciding his rights were violated. As for me, I learned a long time ago to be prudent and not post ANYTHING that could be construed as a death threat or a threat of harm against ANYONE. It's a strange time in which we live and our Fourth Amendment rights seem to be in peril.

It sounds like he's guilty of stupidity and not much else, in what he posted. I'd like to know what was said to LE and the judge to make them think he needed thirty more days in the hole for a psych eval. However, if LE tried to take me away without arresting me or reading me my rights I'd resist, too.
Something tells me this case is going to go far in the news in coming weeks.

ReplyDeleteErinyes, so you think it was okay to abduct (I don't say "arrest" because he was not charged with a "crime" other than resisting arrest or whatever) him simply for speaking his mind? What he said was no different than what was said in the Green Dragon Tavern and elsewhere in the colonies prior to 1776. If that is "disturbing", and you've not read similar elsewhere, then you haven't been around much. Free Speech is not a "crime". Raub's arrest by the "thought police" is very Orwellian. I have said similar things, over many years now. But I have harmed not a soul. Oh, and there's more than one way to execute a revolution as Raub spoke of. Doesn't have to involve combat and death...
ReplyDeleteFrom what I read today (albeit one source) the posts on the page where one thing, however the damning posts used where from a private multiple user chat that was "somehow" monitored by the .gov.
ReplyDeleteWe don't really know all of the details and on the surface and what is known at least from the FB page wasn't any worse than some of the stuff we see everyday online, except from the left directed toward us.

ReplyDeleteFor me, the jury is still out on the Raub case. I do not presume to know all that he did. With the Secret Service involved, for all ANYONE not privy to the entire facts, he may have threatened the president in an e-mail in a fit of pique or a drunken stupor. I don't know Raub and I damn sure don't trust anyone I don't know and a lot of people I DO know, including immediate family members. So I damn sure am not prepared to rally to his support and state with impunity that he is innocent.
Raub is also in Virginia, which has lessened the restraints on LE to Baker Act someone since the Virginia Tech killings.
Having said all of that, the blogs I frequent don't have commenters stating that the government sacrifices babies, or that the 9/11 attacks were an inside job. I don't think the original patriots felt that the British were engaging in human sacrifices, do you?
Having said all of that, I do not think it is acceptable to violate ANYONE'S rights, Fourth Amendment or otherwise. But I also know for a fact, as should you, that there are those among us that need to be scrutinized because they have a screw loose.
The First Amendment doesn't give everyone the right to say anything anytime. Just as the Second Amendment doesn't give you the right to shoot anywhere, anytime. Rights come with responsibilities.
By the way, have you read EVERYTHING Raub wrote? And are you privy to EVERY communication he has sent over the internet?
Last, this case DEFINITELY bears VERY CLOSE scrutiny and monitoring so I am glad the Rutherford Institute has agreed to defend him and IF in fact, his Fourth Amendment rights have been violated I will be the first to rally to his side.

WC - I DO have to admit I'm wrong because we are all in this together. I do not agree with a lot of what Raub believes BUT when any of our rights are violated, and a veteran's to boot, we ALL need to stand behind that person, now more than ever. A famous teacher, Rabbi Hillel, once said "If I am not for myself, who will be for me? But if I am only for myself, what am I? And if not now, when?"
That's always been one of my favorite quotes.
