Man gets mobbed by protesters, shoots one, then gets arrested

ALBUQUERQUE, N.M. - A protester was shot at Tiguex Park Monday evening during a demonstration that was calling for the removal of a Juan de OƱate statue, "La Jornada," outside the Albuquerque Museum.

The injured man was transported to the hospital for treatment. He is listed in critical but stable condition.

So there's a violent crowd who attacks a man while plainly screaming "Kill him!" in the video who allegedly (key word there) brandished a gun. They knocked him down and he cranks off 4 rounds, hitting one. Then they arrest the guy who shot the protester and everybody with him. I'll bet good money that if the man did brandish a firearm it was because he was being or under threat of being attacked.
What's really disgusting is the governor's statement in the article about the incident. Apparently it's okay to riot and destroy property but not okay to shoot in self defense.

  2. The video clearly shows that he was attacked he tried to leave the area and they chased him down and attacked him again this time takeing him to the ground and was being beat by three individuals this is a classic case of self-defense

  4. It's a tough call. A very old principle of law forbids placing yourself in danger, then claiming self defense when the inevitable happens. Armed people have a greater obligation under law to avoid conflict. The exception would be when acting in militia or posse. You cannot self-declare either status.

    2. Ok, so everyone is armed, therefore everyone has a greater obligation to avoid conflict. The law is deficient for if to remove the firearm is to lessen the obligation. And the law is discriminatory for it places the onus on him who is exercises his right.

  5. The first article I read on this yesterday, on Fox News, started with the militia getting arrested and stated that one person was shot. It heavily implied the militia showed up and shot one person before peacefully surrendering to the cops, which is a flat-out lie. There was no description or indication that the individual doing the shooting was exercising self-defense. It implied that the shooter was part of the militia, which has yet to be actually confirmed. Fox News?  Holy shiite.

     

    On a separate note, from the video, it was definitely self-defense. Not that it will help him. It will be a political prosecution and he'll be bankrupted even if found not guilty. Also, admirable that he only fired 4 shots. He stopped shooting as soon as the threat to his life ceased. Just like the concealed carry classes taught. The rioters were lucky he didn't do several mag dumps into the crowd.

    It boils down to the concept enshrined in things like the 2nd Amendment, stand-your-ground laws, welfare and socialized medicine.
    It happens to line up on red/blue divides, but thats the symptom, not the problem:

    The problem is some people want to be responsible for themselves (and accept all that that entails), and some people do not want to bear that burden. Many today like the idea, but don't want to do the work - and that goes for both sides!
    But there it is.

    Many men and women have understood the problem, alas history repeats.

  7. The account I read, I think it was over on War on Guns, said that he was in retreat but the mob chased him. Supposedly he tried pepper spray first, but once they got him on the ground he drew his weapon. At the first of the video, someone did swing at/hit him with a skateboard, that is when he started his retreat.

  13. Video on gunfreezone.net. The guy defending himself was in a three-on-one beatdown (he being the beatee) and one of the attackers hit him with a skateboard.   16. With the current mindset of judges, DAs, public and others it is hard to get a fair shake in the courts.
    Recall the case of Michael Strickland up in Portland or search it, about the same situation.
    Covering pantifa and several advanced with a few decent sized "signs". As he was withdrawing, they kept advancing and he drew his gun which did not stop them, (he eventually got out, I think a few lesser evil folks helped him) but never fired it. Sentenced to 40 days in jail, 240 hours of community service, banned from taking video of people or events for at least 2017 (a yr or so then), and also banned from owning guns.
    And THAT is why so many do not get involved or seem eager to aggressively defend our lifestyle and country. It is even this much of a risk to challenge some gun laws as you have to have standing and the risk is hard to justify the reward, at least that short term one.

    1. His case immediately came to mind when I read the first reports of this one. A gang were about to beat him but were "unarmed" so the jury decided he wasn't really threatened and he got the shaft. Bullshit through and through.

  17. My .02¢ is piss poor planning produced piss poor results. Where was tactical awareness, I saw people milling around through them, comms not apparent, overwatch was either not used or was sleeping on watch. Going into a shit show unprepared, unorganized and uncommitted to the mission is worse than staying home, one of the guys got arrested and gives another bullshit leftist talking point.
    If it's worth doing it's worth doing right.

  21. Whoever wrote that Reuters article is just a crappy writer.. at best,. It says

    Videos show Baca, a counterprotester at a demonstration to remove a conquistador statue, tussling with demonstrators before pulling out a handgun and shooting several times.

    If I hadnt seen the video I would believe the events were
    Baca approaches and wrestles people who are tearing down a statue,then just starts shooting,,

    I would never get from that article that Baca had disengaged, was moving away and was attacked , thrown to the ground by several people,, and finally decided if he was gonna be able to walk away at all,, he was Gonna hafta shoot someone..

    Article also says shooting charges may yet be filed,
    Need to drop all charges and give the guy a medal..
