Lawsuit reveals where off-duty police officer was going when he struck high schooler’s car, killing her

MOORE, Okla. (KFOR) – A civil lawsuit reveals where an off-duty police officer was headed when he crashed into a high school student’s car, killing her.

It happened at the intersection of South Sooner Road and Southeast 134th Street in Oklahoma City.

On Dec. 14, 2019, Emily Gaines was on her way to take the ACT.

Investigators say off-duty Moore police officer Kyle Lloyd was speeding at 94 miles per hour and crashed into Gaines as she was making a left turn.

  1. In the interest of justice, and the punishment fitting the crime, this guy should serve as a living crash test dummy, tied down with breakaway restraints to immobilize him, no safety straps, accelerating the test vehicle to 150 mph before crashing into the wall, livestreamed online. with in car cameras (audio on). For automotive science. If it saves one life.....

    1. I don't agree with that.

      94 MPH would be sufficient.

      Otherwise, carry on.

  4. If it was my daughter I would make sure officer Lloyd knew he was walking dead and make sure it happened.

  5. And what would be the result of the incident if John Q. Public was doing the same thing.

    1. John Q. would still be in pre-trial confinement, awaiting his 'speedy' trial.

  6. Lloyd will probably get QI because no one will be able to find a case where a speeding off duty cop who caused a fatal collision was found liable.

And the reason they won't find a case like that is no one can find a case like that. That's how QI works.

    1. Okay, I give up. What is a "QI"?

  7. "Lloyd will be on administrative leave until the legal proceedings are over."

That tells you all you need to know. Another dirty cop, literally getting away with murder and getting paid while doing it. Not criminally charged, not fired, not decertified, unlike what would happen to a civilian in similar circumstance.

  8. Sunday, 1984, April 8th, 3:30 PM. Pearlington, MS. A city cop was /get this/ intoxicated, on duty, and crashed into the car that my mother, father, 6 year old sister, and I (age 10 at the time) were in as we rounded a curve on a country road. None of us had seat belts on. His speed at impact: 80 MPH. Our speed: 55 MPH. Head on collision. Seat belts at the time were still 'optional'.

All 4 of us were knocked out. Vehicle caught on fire in the engine compartment.

    Police officer's injury: bruised knee.

My mom (28 at the time): mild concussion (passenger seat)

She woke up and dragged us out of the car while we were unconscious in the following order.

Me (10 at the time): severe concussion, covered in blood from my father who was on top of me & bleeding. I woke up about 20 yards from the vehicle before paramedics arrived.

My sister (6 at the time): severely bruised lungs, severe concussion, comatose, nasty head wounds, was unconscious for 5 days in the hospital before she woke up. She was in teh hospital for 3 months recovering.

My dad (age 31 at the time): He was hit in the head by the cop's car during the impact. We know b/c they found bits of his hair & eyebrow on the bumper of the squad car. He also impacted teh steering wheel & broke most of his ribs. He was in a coma for 6 months. Most of the frontal lobe of the brain was destroyed & much of the outer cortex was lost due to fluid build up on the brain during his 'recovery'. He never walked again. He never was able to speak again. He was only able to spell out "FUCK" and "SHIT" on a board with letters on it. He died 11.5 years later from pneumonia which we asked to not be treated when he indicated (to me) with 2 blinks when asked 5 different ways if he was OK with me asking to NOT have it treated. The "SHIT" and "FUCK" was b/c of the lack of enough brain tissue in the front to regulate decisions. His inability to speak was b/c of the speech centers on the left side of the head being crushed by the bumper of the cruiser. His inability to walk was b/c of the brain sitting stationary during impact while the skull was crushed and rotated, causing damage to the brain stem.

Net cost of medical bills paid by us: $0 as far as I know.
Net cost of medical bills paid by medicare: about $5,000,000 after all was said and done. He spent about 9.5 years in a nursing home.

Payment & restitution for property damage, medical bills, and pain and suffering paid by the liability insurance on the police cruiser: $10,000.

Payment & restitution by the Pearlington, MS Police Department: $0.

Payment & restitution by the cop: $0.

    Why $0?

Sovereign Immunity law at the time prevented anyone from suing the state or any government in civil court.

Total lawyers we tried to fight this: 20? 30? Noone could make a dent in the law.

    Stay safe, my friends.

    1. Yea, wear those belts. only my dad would have been hurt had we had belts on. I found the cop about 14 years after the wreck & called him. He didn't get fired but that wreck kinda screwed him up. Hence why I have withheld his name & my own. But this was also pre-internet so there's nothing to search for about the wreck. In fact, the Pearlington, MS Police Department denies that there ever was a wreck b/c there are no records of it. That made suing in court impossible w/o a lawyer willing to actually fight to bring the case up the chain. Lawyers don't really make that much in most cases so without national fame, the case never was heard. It never even went before a judge.

  9. How many speeding tickets do you think this donut eater wrote that month? That week? Or in his hypocrit career as a law breaker cop that didn't give a shit about driving safe, or even driving the speed limit.
He was in a 40 mph zone when he collided, that intersection has a sign, facing the guy as he drove toward the intersection, 40 mph, and it's yellow, next to a sign that is yellow, and indicates an upcoming stop light.
photo of it on my post, inspired by your post, but far more thorough, as I hate bad cops as much as I praise good cops https://justacarguy.blogspot.com/2020/08/last-december-emily-gaines-was-on-her.html
