The court said neither the Emergency Management Act from 1976 nor the Emergency Powers of the Governor Act from 1945 dictate how states of emergency are declared and handled in Michigan, and that Whitmer does not have the power to continue the state of emergency under either law. Therefore, Whitmer did not have the authority to extend her initial state of emergency past April 30, when it was set to expire.

ReplyDeleteOur Empress in Michigan is now saying that she has 21 days to appeal the decision, so we have to follow her orders for 3 more weeks. It was never about the rules, it was about having a single person ruling over the entire state. At least now the legislature will have some input on what rules we must follow here in Michigan.

This all goes to show that the People should not wait on government to self-correct. The People have had that authority since Day One but have mostly been too chicken shit to use it. Its as if a day of reckoning is needed. Indeed, the year 2020 has been bountiful and in unsuspected ways.
Whitmer and many other governors and mayors, including the mayor in my city and governor of my state are perpetuating this tyranny, abetted by the courts in some places. In particular, the mayor of my city was sued by a citizen about his mask mandate. The Supreme Court here upheld his order as necessary to protect citizens health in the face of a declared pandemic. While lockdown rules have been eased state wide, I'm wondering how restaurants are going maintain their businesses come this winter when outdoor dining will be virtually impossible due to the cold. Not to mention they've got jersey barriers set up along most of main street to facilitate restaurants using the sidewalks and parts of the street as outdoor dining space. It'll be fun watching snowplows do their job around those obstacles. I wonder if jersey barriers are subject to existing snow emergency regulations?!?!?

DeleteThe Michigan Attorney General announced that because of the court ruling, she will not enforce Whitmer's orders. That announcement only covers the state police. The AG doesn't have authority over county and municipal police.
ReplyDeleteI am not lawyer myself, but I heard the attorney that is defending Karl the barber say that county officials could be sued PERSONALLY if they try to enforce these rules. I hope that his enough to end the nonsense.
