I didn't realize this was still an issue

FORT WORTH, Texas (AP) — A grand jury in Texas decided Monday to take no action against a man who fatally shot an armed man who killed two people at a Fort Worth-area church in late December, prosecutors said.

  5. Can't find the reference right now but They said on TV that all self defense deaths are treated no differently than a homicide in Texas until they go over the evidence. Sounds redundant to me. especially with the video evidence showing he acted in self-defense.

    1. I don't agree that it was truly self defense, but I definitely agree with both his actions, and the grand jury's decision.

    2. Any time a human kills another human, it's a homicide. Homicide isn't illegal - murder and manslaughter are.

      But yes, all homicides in Texas go in front of a grand jury. That's the law here.

  6. DAs have a LOT of say over what gets prosecuted and what doesn’t. Many only go for the slam dunk as they keep a tally of their records for wins and losses, like coaches for sports.

  7. Pretty sure that in Texas ALL homicides go before a Grand Jury, a requirement of the law there. So this was pretty much a rubber stamp. But yes.....in many places, like OMAHA! a grand jury is used to persecute and crucify.

  8. There's no statute of limitations on murder, so if the DA decides to do nothing, he can always bring you up on charges 20 years later. But if a grand jury no-bills it, then you're done. At least as i understand it. So the grand jury step basically kills it dead.

  9. I live in Texas. This is the law. All those shootings are referred to a Grand Jury for review. This is SOP. The Grand Jury only meets a few days a week. Handles thousands of different types of cases yearly. What is so hard to understand? It came up, was reviewed, no issues, end of story.

    1. Different state laws. I think we understood it to be that the DA was still trying to get an obviously self defense case, charged with murder or manslaughter.

  11. The wait time for a Grand Jury to examine a case in Texas is VERY long. This was just when they got around to him.
