A divided three-judge panel of the Illinois 2nd District Appeals Court Friday lifted permanent injunctions issued last year by a Lake County judge, which had forbidden village officials from enforcing any part of the Assault Weapons Ban Ordinance trustees passed unanimously in April 2018.

It won't stand. This will head up to SCOTUS and be overturned in a 5-4 vote. Until then the people of Illinois need to demand Chitcago election reform.

The writer of the article seems to confuse magazine capacity with ammunition caliber. The town may not regulate handguns, but since some handguns have magazine capacity more than 10 rounds, the town may not regulate handgun ammunition. ??
ReplyDeleteIt’s a messy intersection of state and local law. There is no established case law that I know of where these waters have been tested and as long as this ban is being actively contested it’s unlikely that there will be.

DeleteAs a former resident of Deerfield, I bought a particular rifle that would scare the pee out of the Progressive Intelligencia, but does not violate any of their restrictions. Furthermore, state level preemption should invalidate a local magazine ban, but that too will need to be tested in the courts.
What can one do? Give to the IL State Rifle Association (ISRA.ORG) or Second Amendment Foundation (SAF.ORG) and help financially fight this turd.
