Lawyers for landlords ask federal court to block new eviction moratorium

Lawyers for a group of landlords and real estate companies asked a federal judge in Washington late Wednesday to put on hold the Biden administration's new eviction moratorium that prohibits landlords from evicting certain tenants who fail to pay rent amid the COVID-19 pandemic. 

The filing marks the first challenge in federal court to President Joe Biden's latest efforts to stop evictions and comes after the administration allowed a previous freeze to expire, setting off fury among members of his own party.

    1. That would only make sense if they had taxable income, and deductions in excess of the (now much increased) standard deductions.
      As intended, this will asset-strip and bankrupt those of the middle class who sought security in rental property against the threats of inflation and devaluation of Social Security payments.
      In other words, those conservative and forethoughtful enough to try to provide for their own retirement, and to leave something to the kids.
      Bankruptcy by the landlords might stop the losses, but it will not give those investors their years of work and sacrafice back.
      Just collect the rent? B*llsh*t. Take the call at 3AM that the basement is flooding, try to get the small pump working until you canbrent a big one at 7 AM, then try to find a plumber willing to come out that day, while paying for a hotel for the tenants. Because these are one of those tenants who pays their rent on time, every month.
      And try to keep the water level below the furnace and water heater, so that you don't lose them, too.
      Yes. You can carry capital losses forward, but that is only useful if you have capital gains.
      Another perverse effect of the increased standard deduction is that most states have not increased theirs, which means that if you take the larger and simpler Federal tax, you can't get the benefit of itemization at the State level, resulting in higher taxes no matter what you choose to do.

  6. This is a tough one. If you're eating out of a food pantry, then there should be a *little* mercy. But gov should be on the hook. It was their idea in the first place.

    My forbearance just ran out, and the cocksuck WOP that runs my state won't let MY industry to resume. Feels like a lawsuit to me.

  7. Do yourselves a favor and go look up Vanguard, Blackrock and American Homes 4 Rent. These companies are buying up everything they can get their hands on, late on your mortgage for your investment properties, talk to one of them. Now I'm not saying that this moratorium scam is to bankrupt small investors of rental properties but if someone would dumpster dive the political contributions of those companies what do you think you would find.

    The rent delayed was only supposed to be short term and was a big reason why people decided to go into lock down. You can be sure a lot of that won't happen a 2nd time if Lock-Down II occurs.

      Same thing was said during the mortgage crash - and we're still chugging along. Yes, it absolutely will come tumbling down at some point, but they can keep the plates spinning for a long time.

  9. I'm pretty sure I covered this yesterday in an article similar to the title of this one.

    This "moratorium" is all part of the plan to bankrupt mortgage holders into default so that banks can start taking over a huge amount of residential and commercial properties throughout the country. Once they've accomplished that, they'll commence putting all of the delinquent residential renters out on the street, adding astronomical numbers to the homeless population, further raising the chaos level in the country.

    Oddly enough, Tucker Carlson covered this same subject in one of his segments last night and said pretty much what I have, although he added some speculation that landlords could be subject to criminal penalty for forcing people to pay up.

President Puddingcup admitted yesterday that allowing an unconstitutional eviction moratorium to continue will give them time to send out rental assistance checks as any lawsuits challenging it work their way through the courts but as Georgetown law professor Jonathan Turley pointed out yesterday on Twitter, the first step any court will take is to order an injunction halting the program while it works its way through court. In other words, 46* won’t be buying time at all.

    Save your tender sympathy for owners who just lost the rights to their property.

  12. Problem is landlords don't always own their property outright - they may have a mortgage. The lender can take possession of the property from the landlord for nonpayment and no one is evicted. Banks win again!

I actually don't understand how, when the fed. gov. has not only given the unemployed workers their unemployment, but an extra 300$ per week, plus stimulus checks, there is any reason that they would not be able to make their rent payments. One thing you can be certain of, when things are all said and done, the landlords will move to evict, and the renters will attempt to force the landlords to return the security deposits, even though their rent is months behind, and some liberal judge will force the landlord to give it to them, since the deposit was for damage to the residence, and not for unpaid rent.
    Of course, the landlords will all be screwed out of thousands of dollars in rent, with no possible way to recover. They can sue the renter who will just move to a new place, but even if they win a judgement, it is unlikely that they will ever get a dime from the renters. Trust me, I have been there, and my lawyer explained this exact thing to me. With my parents estate, and a brothers daughter, it cost me thousands of dollars, both for this daughter of his and for another daughter of his, in a different house of my parents.
    I predict bad thing coming out of this, for a very long time, with much trouble trickling down.

  15. One of our next door neighbors has a brother in NY who owns a rental property where this going on. According to his brother, his tenant - in a single family home - just stopped paying the rent around eight months ago. When he asked his tenant why this was happening, he was told, "The government says I don't have to." and now he has no recourse as the town in which this property is located has told him that he still owes property taxes on the building. He can't get a break on paying them either, as the local clerk told him, "Well if you can't make the payments, we'll be more than happy to take it off your hands." so that's part of the game given away right there. There is a website for NY state residents and landlords to recoup money who need it, but apparently it doesn't work and no one can access the two billion dollars set aside in it. I joked with this guy saying that when this scumbag guido governor runs for re election next year, he'll probably use it as a slush fund for his campaign.

We the people now need to ask for our unalienable liberties from a system designed to steal them under a guise of health and or safety. We do not have a system designed to protect our life, our liberties and or our pursuit of happiness from tyranny of what is best for other people. We have a system designed to make US healthy , safe and pliable subjects to an unconstitutional democracy that is going to make US just as safe as the Germans made the Jews back in WW2. This will end poorly for one side of this argument. Lets pray that they will be willing to peacefully leave the country instead of having to piecefully leave the world.

    Nobody is *allowed* to *own* land ("real" estate).
