With people running away, officers moved in, service weapons drawn. They put the 26-year-old in handcuffs and confiscated his gun. Tussey was later charged with terroristic threatening, wanton endangerment and disorderly conduct, prosecutors said, and could face up to 20 years in prison.
His lawyer says he “was engaged in perfectly legal behavior” in the incident last year, raising a relatively new legal argument in the United States that now stands before the courts to settle.

What a crock of shit from the leftist hand-wringing MSM.
The article states that gun violence is up in the US with 35,000 deaths so far this year, but fails to state how many of those deaths were justifiable shootings or how many of those deaths were caused by criminals.
I'm still waiting for the bloodbaths the Left predicted since Kentucky and then Tennessee enacted their permitless carry laws.
Many of those gun related 35,000 deaths were justifiable shootings or how many of those deaths were caused by criminals. What about suicide by gun? What's the stats on that method of a self-inflicted journey to non-existance?
ReplyDeleteMost of them were gang related in liberal safe havens like Chiraq, Detoilet, Killadelphia and the like.
DeleteThis whole thing will open the door to a flood of lawsuits, especially when a case is dismissed or a "not guilty" verdict ensues.
ReplyDeleteJust because it's legal doesn't mean it is wise to do it. I assume (maybe wrongly) that the states where open carry is legal, also have legal concealed carry. Why advertise that you are armed? I guess, however, that doesn't work so well if you carry a rifle or shotgun.
ReplyDeleteWell, I don't intentionally open carry, but if I'm in a T-shirt and carrying a 4 inch 357 magnum, I'm not going to worry about some snowflake's nerves if they see a bulge or part of the gun, and I'm damned sure not going to downgrade to an ineffective .380 or 9mm.
DeleteBecause I am a free man. Here in Western Kentucky, you see quite a bit of open carry. Just a part of the landscape. Most people never notice it.
DeleteNorth Carolina has constitutional open carry, but does not have constitutional concealed carry. I open carry on my property, but wouldn't in town.
DeleteWhen Texas passed concealed carry laws that required training and an FBI background check, the whiners screamed that there would be blood flowing in the gutters, shootouts at high noon, and people would be gunned down just for reaching for their wallet. Nothing happened. When open carry was passed, also requiring training and an FBI background check, cries went out that there would be hordes of people with firearms strapped to their hips terrifying the populace. Signs went up in businesses around the state prohibiting entry with an openly carried firearm. In the years since that law passed I've seen maybe three people openly carrying a firearm. A couple of those may have been officers, if you dress nice it's hard to tell. None of the cries of the panic stricken have come true. I'm sure they're disappointed.
ReplyDeleteArizona has constitutional carry -- if you're legally allowed to own it, you're legally allowed to carry it however you want (some exclusions apply, like bars).
DeleteBack when Wal-Mart sold ammo, I would regularly see people open carrying.
One time in a pawn shop, with about 9 people in the place, I realized everyone was carrying: 8 open carrying (and my concealed carry).
Treat guns like you do cars. Wirh caution but also not a threat until they do something threatening. Would you pull a guy over who was operating their vehicle in a lawful manner? If course you can always quit the force instead of wetting your pants every day.
ReplyDeleteRE: You can always quit
DeleteTHIS! If an officer's main concern in the morning is coming home alive, they need to quit. They are unsafe to themselves and to the community that they serve. Life's too short to be seriously worried that you're going to die each day.
35000 deaths in the US, and 79% from guns(27650).. The flu, Covid, and Monkey Pox better get to killing people! If they are going to lie, they could at least try to be some what realistic about it.
ReplyDeleteAnd what, over 930,000 people are killed each year by a woman's right to choose?
DeleteI always laugh when people say women would be more compassionate leaders. Women choose to kill more people every year than men do. By a lot.
Kentucky has had permitless open carry since we became a state. The Kentucky State constitution only allows the Legislature to regulate the concealed carry of weapons. All the 2019 law did was remove the permit for the concealed carry of weapons. If this guy was walking down the street with the firearm in plain view the 2019 law had nothing to do with it.
ReplyDeleteMy lefty daughter said she and nearly all her lefty friends voted against the gun control referendum here in Oregon, Measure 114, because they "want gun control that isn't redundant and doesn't give police more budget". I gave her credit for recognizing that the referendum is redundant w/ current federal law, skipping over the constitutionality of the federal law for the moment. It's not clear to me how they can wish 'gun control that doesn't give police more budget' into existence, but I'll pursue that question some other time.
ReplyDeleteOne thing all politicians and reporters _should_ understand or be considered unfit for their jobs: your irrational fear is no reason to restrict my constitutional right.
ReplyDeleteArizona is Constitutional carry. Sure there's shootings, but nearly all are in the big cities by the *usual suspects*. Makes people damned polite when they cannot know who or who isn't carrying.
ReplyDelete35K deaths attributed to firearms is the average year since forever. More people are killed by auto accidents every year. The difference is only about 2K, but auto accidents still kill more.
ReplyDeleteSo, should we ban cars?
Same stupid argument as with firearms, not to mention that the number of people killed by rifles is fraction of the total.

And the vast majority of those are suicides.
DeleteAnd while suicide can be considered a tragedy, most of the 11 suicides that I know of, the person was terminal and faced extremely poor quality of life. One, in theory, could have been helped by decent counseling. Another could have been helped by just having a person to talk to (she was a 20-something female and my wife would have been really upset if I had attempted that role).
DeleteVirginia has open carry and concealed carry. Pretty much everywhere - there are exceptions of course. For example the courthouse and liquor store. There are others, but in my county the Sheriff and deputies are okay.
ReplyDeleteRagnar
These f'in retards would arrest and jail guys with LEOSA creds, i fielded numerous calls trying to talk some LEO down off the OMG a gun in maryland or Wisconsin ledge without a state mother may i card. Criminals dont need permits, so why should i?
ReplyDelete2A doesnt mention the right to keep and conceal arms, but to bear them. Id rather see nationwide, non-licensee open carry for numerous reasons.
ReplyDelete"doesn't mention the right to keep and conceal" ... that is a really nice type of idiocy. Consider it doesn't say anything about the right to use magazines. It doesn't say anything about the right to use a scope. It doesn't say anything about ... a lot of things.
DeleteIt is unfortunate that the heirs to the founding fathers are such totalitarian control freaks.
