Ban on marijuana users owning guns is unconstitutional, U.S. judge rules

(Reuters) - A federal law prohibiting marijuana users from possessing firearms is unconstitutional, a federal judge in Oklahoma has concluded, citing last year's U.S. Supreme Court ruling that significantly expanded gun rights.

  1. Haha, if that is true, then go check the yes box on marijuana user next time you fill out a 4473 and see what happens. Bet you won't be getting your pistol anytime soon. I'll be believing the illegal drug use thing when that question is removed from NICS.

  3. I don't understand the ruling, since weed is still a federal offence on par with possession of cocaine. But as long as you are not high at the time you are in possession of the gun, I see no real problem with it.
    If you are drunk or high, then it becomes a problem, since if you shoot someone, even if it is a "good shoot" as far as criminal law goes, you are likely to see a different result in a court of civil law, when sued for a million dollars by the eagle scout's family.
    There is a simple solution, and the is to just legalize all drugs. Just like prohibition made men like Al Capone and Bugsy Siegle, so to has the war on drugs made a criminal element out of people who would have likely been small time crooks, but due to the huge profit in illicit drugs, they are able to build a huge criminal enterprise.
    I don't think that would be surrendering to a war we just can't win, but instead we would be realizing that you can't change human nature. And if someone can buy cocaine for a dollar for one high, instead of 20 dollars, or what ever the price, they are less likely to have to steal or commit serious crimes like strong arm robberies or armed robberies of corner stores, to get the money to pay for the inflated price of cheap drugs. Again I am not saying that we surrender, just that we see things in a more realistic way, and stop the extremely costly and ineffective incarceration of mostly non violent inmates.

    1. On top of incarceration costs, consider how the War on (some) Drugs has raped the Bill of Rights. For example, your 4th Amendment right against warrantless searches? Not if a trained dog, who cannot be cross examined and who wants the approval of it's handler, sits, stands, barks, wags it's tail or make some other sign you lose your protection of the 4th.

  4. Here in Virginny weed is legal and it is even legal to grow on your property.

    Which tyrants decided to legislate control of, banning of or taxing of a plant?

    Coke, meth, LSD, heroin, designer party pills are a different. They all require processing - doesn’t turning coca leaves into cocaine involve gasoline?

    I don’t recommend driving, using power tools or firearms after use of weed, but there is no way it’s on par with those other drugs.

    Now alcohol. It’s legal here to brew your own beer or make wine. But you need a permit to distill whiskey.

    None of it makes sense unless you consider it’s another way for a given bureaucracy to steal money from people.
