The state representative was only partially correct in the fact that he couldn't be detained. He cannot be detained if he is on his way to a session of the legislature. I don't think he could argue that he was on his way to a session of the legislature at 4AM while sitting at a bar.

I'm not sure if it's some/most/all states/feds, but there are laws that protect legislatures from the executive branch while they are on the way to perform their legislative duties. It would prevent a draconian situation where someone like Biden might have legislators arrested who were on their way to vote against some legislation he wanted passed.

This asshole is an all around fuck-up. Just got a pass on DUI charges in 2019 and thinks it's a good idea to be drinking at a bar past legal drinking hours. With losers like this in there ranks, the Republicans haven't got a chance. SMDH!
