NASHVILLE, Tenn. (WKRN) — Tennessee leaders were inundated with calls Friday from across the country, asking them to reinstate Justin Jones following his expulsion from the House of Representatives. It’s a move that the majority of Metro Council members support and one that could come Monday.
The Republicans will always cave because they want to "be fair". That's something the obsessed Democrats would never do. I refer you to the J6 POWs for example.

How about the expel him again, once the council reinstates him.
ReplyDeleteI read someplace the other day that if he comes back, they can't expel him again for the same thing, kinda like Double Jeopardy.

DeleteOnce expelled, the Tennessee Constitution and House rules do not allow for him to be reelected or reinstalled to the same position until the next general election. The Metro Council can chose his replacement, but once again, the Tennessee Constitution and House rules do not allow this.
ReplyDeleteState constitution says "successor"- ie, not the same guy, see the definition- and requires as special election as it's more than 12 months before the term ends. So, yeah, they can try to appoint him, and very likely will try- but the majority and the speaker will probably challenge that in court. At which point, he's a) not seated; b)the seat is unfilled; and c)there it sits while the court case winds thru. Loser for the Dems. IF he's re-elected, to a new term, he's OK; can't be expelled again for bad behavior. But, reappointed, not re-elected? Too many ways to challenge the appointemnt, including refusing to seat him. The republicans are taking a lot of heat for not tossing the babe from Knoxville. They're not likely to be very forgiving on this guy.
