PRESCOTT, AZ (3TV/CBS 5) -- A Yavapai County Superior Court is finding herself on the other side of the law after being accused of driving under the influence.
According to court records, Celé Hancock faces four counts of DUI charges, including Super Extreme DUI after being arrested by Prescott police officers on Sunday. For reference, a BAC of .20 and above is classified as Super Extreme DUI.
Sometime in the early 80's my uncle got rear ended at a stop light. Cop showed up and realized my uncle had been drinking. Not stumbling around, not slurring, just smelled of beer. Breathalyzer came back at .34. Cops thought it had to be an error and tested again. Came up as .33. My aunt said when they went to court the judge was amazed and repeated .33 several times as if he didn't believe that number.
So I guess his would have been Super Duper Extra Extreme Mega DUI
That shows the issues with modern DUI laws, not unlike their approach to gun related and other crimes. They keep lowering the standard (I predicted when MAD first petitioned to have it dropped to 0.08, they would keep ushing until it was 0.00) which to a certain degree does not really solve the problem and hits the casual drinkers (couple out for dinner with wine or a couple of cocktails, etc) and not the hard core alcoholics like your uncle. Those types need to have a couple of drinks just to get to their functioning baseline, prevent the shakes, etc. They have a screwdriver or Bloody Mary with breakfast, something in the coffee, couple of shots during the day or at lunch, then stop by the bar for a few more. I don't believe in driving drunk, although technically I have done it (as well as not even technically when younger!) as has anyone who has a couple after work or other. The fact they allow so many instances is the problem, harsh penalties with counseling or awareness for the first and a serious warning about subsequent violations. Then take their license, jail time and other measures to try to prevent them from driving again. I don't think the car should be taken unless you are single, and it would not further harm the family. Of course, not having a license or car doesn't mean they will not drive, but not sure what else we could do without going draconian like other countries.
You DON’T screw around in AZ drinking and driving. If you get caught at .08 (your 1st DWI) and the judge absolutely loves you, it will cost a minimum of right around $8000 and mandatory jail time.
There is the separate charge of DUI, “proven” by dash cam or designed to fail Field Sobriety Test or your big mouth. It can be given if UNDER .08. Cop asks, “On a scale of 1-10 with 1 being just slightly buzzed and 10 being drunk as can be, where are you right now?” (The correct answer is zero) Most folks think the scale starts at 1 and now you just confessed to “Impairment to the Slightest Degree” - AKA - DUI. Get another DWI within 84 months? You are well and truly fucked!
Well darn! I guess my .23BAC back in '82 made me a Super Extreme DUIer. Now I truly feel accomplished.
