President Joe Biden plans to announce that he is directing the ATF to close what Everytown calls the “private sales loophole” and the “digital loophole.” The “private sales loophole” is when an individual sells a firearm for profit but does not possess a Federal Firearm License (FFL).

ReplyDeleteIt's amazing how well requiring criminals to fill out forms first stops them from obtaining weapons illegally. Why didn't we think of this 1,000 years ago?

ReplyDeleteDon't miss the fact that it not only has the goal of stopping the private sale of firearms, but it would also require registration of any gun you want to sell. And of course there is the hassle involved if you decide to actually get your FFL license of the BATFE having the right to inspect your books. It used to be that they had to have an appointment during regular business hours, and they inspected home FFL's once per every 12 months, but in reality did so way less. Now no doubt if they wanted to, perhaps, check your books for a gun used in a crime, they would come as often as they wanted to, and rest assured that anything that got their attention, like a wrong post on Meta or something like that, would make you a target for the elimination of your FFL, and possibly a hefty fine and prison time, for failure to follow the rules.

The problem is that with certain rare exceptions, unless you have a storefront, you can't get an 03 or "Dealer" FFL. It says right on the application for the FFL "No internet sales only."
DeleteThe problem with being a "Kitchen Table Dealer" is that the ATF gets to do their compliance inspections in your home.
And "And every legal court challenge is costly in both time and money" is exactly the point of this bullshit regulation getting a (prohibited) database of guns and gun owners is just gravy.
