Texas’ abortion ban too restrictive for women with pregnancy complications, judge rules

AUSTIN, Texas - A Texas judge ruled Friday the state’s abortion ban has proven too restrictive for women with serious pregnancy complications and must allow exceptions without doctors fearing the threat of criminal charges.

  3. From the article, "Under the law in Texas, doctors who perform abortions risk life in prison and fines of up to $100,000. Opponents say that has left some women with providers who are unwilling to even discuss terminating a pregnancy."

    Is that true? I thought the enforcement was through civil court, not criminal. I'm almost certain (and a quick search confirms it) that the action is brought under wrongful death. Even Wiki agrees, "The law can only be enforced through private lawsuits."

Each of the bills explicitly forbade state officials to enforce the law in any way, and instead authorized private individuals to sue those who perform or assist abortions after cardiac activity had been detected for $10,000 per abortion, plus costs and attorneys' fees. In structuring the law this way, the authors sought to shield it from judicial review in federal court, because lawsuits challenging the constitutionality of a state statute must be brought against state officials charged with enforcing the disputed law, rather than against the state itself."

  6. There has always been a giant loophole in every law restricting abortion - exceptions for the health and safety of the mother. Mental health is health. All a woman has ever had to do to get a late-term, no-restrictions abortion is claim that she is so upset about the pregnancy she will kill herself if forced to go through with it. Boom, abortion is medically necessary to save the life of the mother.
