I’ve had to choke a dog because it got loose, ran through traffic and attacked my dog. My guess is the dog attacked the guest trying to “defend” its owner. Just in case anyone missed this point in class, a dog is very low on the save an animal over human list. Because of this man’s actions, he will go to jail and the dog will be put down. Seems like a triple win here

You're the one drew your own conclusions about what happened in the link, then went off topic and started talking about shooting dogs over being on your property, first killing chickens and lambs before switching your story over to ducks, when the article had absolutely nothing to do with that. How does the man prove his dog was choked and it's justifiable? He better lawyer up. I'm not sure what to believe in this story, except that someone was shot is factual.
In Idaho, unfortunately, dogs are 'possessions', in other words, property. Defending your 'property' with deadly force is very much a crime. That said, you lay a hand on Ellie, I'll kill you, they'll never find your body. Do something bad enough, I'll work to erase your family name. Since I retired this week, I'll have plenty of time...
I don’t think I’d want to call my attorney over such an obvious and blatant misuse of force. If a dog attacked me or my family I’d blast it but dogs fighting each other is what dogs do. Yes, there is a livestock harassment law in my podunk state and just chasing cattle will get your dog shot real fast. My neighbors think it’s ok to just let their dogs run the neighborhood and they have decimated my backyard flock numerous times but I think popping the dog over it isn’t the answer. I just don’t let them out of the pen any more. Bad or inconsiderate neighbors are pretty common and killing their pet probably isn’t going to help that situation.
Here in West Oz, we have protection of live-stock laws allowing dogs that attack livestock (cows, sheep, chickens etc) to be shot. Those laws do not apply to domestic pets, nor apparently to humans.
Years ago my former next door neighbour's dogs (two Rottweilers) attacked my wife and our two young children (both under 6 at the time). I was at work at the time.
My wife needed 14 stitches for a bite wound to her butt, our daughter lost skin from knees and elbows when she was driven into the ground while running away in panic, but our son was physically unharmed as my wife lifted the stroller he was in and kept herself between the attacking dog and the stroller. To this day (twenty plus years later) he is terrified by large dogs.
Police said, "It's an Animal Control problem." Animal Control said, "We didn't see, so it didn't happen." I said, "If those dogs aren't gone by tomorrow, I'll shoot them both. and if you want to argue about it, you're next."
Fortunately, the owner relocated the two dogs, and I didn't go to prison for murder.
