A City Gear loss prevention employee was arrested after shooting a threatening customer, according to Memphis Police Department.
Robert Tucker, 19, is charged with attempted second-degree murder, reckless endangerment with a deadly weapon, and employment of a firearm during the commission of a dangerous felony.
I had to read this one several times to make sure I had the victim and suspect correctly identified in my mind. Still not quite sure how this played out. I do know that if you tell me you are going to kill me and don’t care about my gun,, then start approaching me, you will thereafter be referred to as the deceased. I am not going to fight you. Eod1sg: Let me try. First, I get your point. I am old and broken down, too. I have lost a lot of my strength, i really don't put up with pain well, and it is very hard to heal from even minor injuries. So, looking at an attack by any one, I would be inclined to respond using any weapon I had at hand, even lethal force. And, I don't really think I would have any compulsion to restrain myself.
But the law is normally concerned with proportionality. If the attacker is only verbal, then no amount of force would be justified. If the attacker uses fists and is not even armed, then a response using arms would be suspect. There seems to be this fairy tale that any one person's ability to injure is not any different from everybody's. So, if you deploy a disproportionate response, you are committing a crime.
Each state has its own laws and what would be a reasonable response in one state would be unjustified in others. My response has been to withdraw from areas where I suspect that the natives are "impolite".
If the angry customer had done everything he/she did to a cop,would the cop have felt it necessary to shoot? Or taze? This guy doesn't have a tazer. IDK,, I don't have an opinion on this one. Threatening to Have someone beat up? Obnoxious? Yeah, but I'm not seeing the Immediate Danger.
