Climate Lawsuits Fail in State Courts, But Critics Warn that Lawfare Still Achieves its Goals

New Jersey State Superior Court Judge Douglas Hurd dismissed a lawsuit last week against major oil companies. The state of New Jersey alleged the companies sold products that cause global warming and misled consumers about that problem. 

“In conclusion,” Judge Hurd wrote, “only federal law can govern Plaintiffs’ interstate and international emissions claims because ‘the basic scheme of the Constitution so demands. Therefore, Plaintiffs’ complaint is hereby dismissed with prejudice for failure to state a claim.”

    1. Revoke their license to practice law, then cancel their college and highschool diplomas and inform them they can live out their days flipping burgers or digging ditches because their possessions are forfeited to pay defendants costs.

  3. A practical way to eliminate frivolous lawsuits would be to require the plaintiff to post a large bond when filing the lawsuit, which is forfeited if their case is lost.

  4. Last year the climate law suites had the backing of all the govt agencies and doj. Now they have zip. So they will have to go on hold for 4 years.
