A private security guard who claimed self-defense will face a second-degree murder charge in connection with the shooting death of a man following political rallies last weekend, the Denver district attorney’s office said Thursday.
Matthew Dolloff, 30, will be charged on Monday for killing Lee Keltner, said Denver District Attorney Beth McCann. If convicted, Dolloff, faces up to 48 years in prison, ABC News reports.

ReplyDeleteIn CO, a 2nd degree felony carries a penalty of 8-24 years with 5 years parole. However, if it is a violent crime, which murder certainly is, the penalty is doubled. Therefore, the 48 years is a maximum.
ReplyDeleteI suspect the defense will try to get charges dropped to 3rd degree by arguing the shooter was provoked (self-defense). Still, because it was a violent crime, the maximum would be 24 years.
The lesson here is if you are carrying, be damned sure of what you are about to do. That has been preached again and again and again. Some folks still ain't getting the message. Read and understand Andrew Branca's several books on self-defense.

DeleteThe videos suggest a 2nd individual was involved for a "provocation" while pretending to be a licensed security guard. That sounds like conspiracy and/or "murder one".
