In an op-ed published in the left wing Gannett-owned Tennessean, TN-5 candidate Morgan Ortagus effectively told the GOP-controlled Tennessee General Assembly to drop dead. She advocated against pending Tennessee General Assembly legislation that would establish a three-year residency requirement for candidates who seek to be on the ballot in primaries for the U.S. House and the U.S. Senate.

ReplyDeleteTennessee may well pass that Law and enforce it for State run elections and races, but a Congresstional race falls under Federal Election Laws and Rules. It would not apply to a Federal Congresstional election.
It would be a Unconstitional law sure to be thrown out, when challenged except 'maybe" for State elections. Though I doubt it.
Besides that TN 5 hasn't elected a Republican in well over a hundred years.
So I wouldn't worry about a possible plant carpetbagger in Trashville any time soon!

The states can make residency requirements for local and state elections, but have not been able to for federal elections. The Constitution simply says that the officeholder has to be a resident at the time of election. This would fail with any lawsuit. I suspect that the TN Senate is sending a message as to who she can expect support from as much as anything. She's not the only carpetbagger. On the point of TN5, the lines have been redrawn considerably and that is what is attracting the attention of potential candidates, all R''s and almost 10 of them at this point. That was the article writer's "artistic interpretation" of her disagreement with this new (possibly unconstitutional) legislation. She's a damned carpetbagger, but she never said anything as juvenile as the headline/tagline indicates.
